This Privacy Policy describes how Forerunner Industries, Inc. and our subsidiaries and affiliated companies (collectively, “Forerunner,” “we,” or “us”) collect, use, disclose and otherwise process information about you. This Privacy Policy applies to information we collect when you access or use our websites, mobile applications, and other online products and services (collectively, the “Services”), or when you otherwise interact with us, such as through our customer support channels. Where we process personal information in the course of providing our platform, we may do so as a service provider/processor on behalf of our customers. This Privacy Policy does not apply to our activities as a service provider/processor. 

We may change this Privacy Policy from time to time. If we make changes, we will notify you by revising the date at the top of this policy. If we make material retroactive changes, we will provide you with additional notice (such as by adding a statement to the Services or sending you a notification). We encourage you to review this Privacy Policy regularly to stay informed about our information practices and the choices available to you.

Collection of Information

Information You Provide to Us

We may collect information directly from you when you create an account, request customer support, or otherwise communicate with us. The categories of information we collect include:

  • Identifiers: we collect your name, email address, mailing address, and phone number. We also generate an identifier that we associate with your account.
  • Professional Information: we collect your job title, name of employer, professional background, and the nature of your relationship with us. 
  • Account Information: we collect information about your account credentials, as well as the Services you are interested in, purchased, or have otherwise used in connection with your account. 
  • Communication Information: we collect information included in your communications with us, including the contents of custom messages sent through the forms, chat platforms (including our online live chat or automated chat functions), email addresses, or other contact information we make available, as well as recordings of calls with us, where permitted by law (including through the use of automated or artificial intelligence tools provided by us or our third-party providers).

We may also collect any other information you choose to provide.

Information We Collect Automatically

We, and our third-party partners, may automatically collect the following categories of information:

  • Internet Activity Information: we collect information about how you access our Services, including data about the device and network you use, such as your hardware model, operating system version, mobile network, IP address, unique device identifiers, and browser type. We also collect information about your activity on our Services and interaction with our communications, such as access times, pages viewed, links clicked, and the page you visited before navigating to our Services.
  • Precise Geolocation Information: We may ask you for your consent to collect precise geolocation information through our mobile application. If you consent, we will collect information about the precise location of your device. You can withdraw your consent and stop the collection of precise location information by changing the settings on your device.
  • Support and Chat Information: We, and our third-party partners, may automatically monitor, review, record and retain  conversations you have with the chat features of our Service and our customer service team.

We, and our third-party partners, use tracking technologies, such as cookies and pixels, to collect information about your interactions with our Services and communications. These technologies help us monitor and improve our Services and communications, see which areas and features of our Services are popular, count visits, track clicks, remember information so that you don’t have to re-enter it during your visit or the next time you visit the Services, and provide other features of our Services. You may be able to adjust your browser settings to remove or reject browser cookies. Please note that removing or rejecting cookies could affect the availability and functionality of our Services.

One of the tracking technologies we use is Google Analytics. Information We Collect from Other Sources

We may also obtain information from other sources. For example, we may collect information from publicly available resources (like social media or industry directories), identity verification services, your employer, other customers, and data analytics and other service providers. This information may include your name, contact information, and employment information.

Derived Information

We may derive information or draw inferences about you based on the information we collect. For example, we may make inferences about your approximate location based on your IP address, as well as inferences about your interest in our Services based on your interactions with us.

Use of Information

We may use the categories of information we collect for the following business and commercial purposes:

  • Service Delivery: we use information to provide and maintain our Services, including to create and authenticate accounts, facilitate the relationship we have with you and the company or agency you represent, and to allow Guest Users (as defined in our Terms of Use) to submit data to applicable government agency customers through the Services.
  • Communication: we use information to communicate with you about Forerunner and our Services, including to send you newsletters, respond to your questions, inform you of price changes, and send you other transactional or relationship messages.
  • Marketing: we use information to send direct marketing messages (including via email). You can opt out of direct marketing messages we send by following the instructions in those communications (such as by clicking “unsubscribe” in the emails) or by contacting us as set forth below.
  • Research and Development: we use information to monitor and analyze Services and customer trends, usage, and activities, improve our products and services (including by training or fine-tuning our and our third-party providers’ artificial intelligence and machine learning models, subject to any agreement we may have with you or the customer you represent), develop new products and services, and generate de-identified data (which may be used and disclosed for purposes outside the scope of this Privacy Policy).
  • Protection and Compliance: we use information to detect, investigate, and help prevent security incidents and other malicious, deceptive, fraudulent, or illegal activity, help protect the rights and property of Forerunner and others, and comply with our legal, contractual and financial obligations.
  • Notice/Consent: we may also use information in other circumstances after giving you notice and/or getting your consent. Where we have your consent, you may withdraw your consent by following the instructions provided when your consent was requested or by contacting us as set forth below. 

As noted above, we may use your information to improve our services and train or fine-tune the artificial intelligence and machine learning models that power our platform and services (subject to any agreement we may have with you or the customer you represent).  

Disclosure of Information

We disclose the categories of information described above as follows:

  • To Your Employer or Account Administrators: if you interact with our Services in connection with your employment, we may disclose information to your employer or another company for which you work. For example, we may provide information to your employer about your customer support requests. If you enable location sharing through our mobile application's "location sharing" feature, we will also share with the account administrators (i.e., managers) of the Forerunner customer through which you access the Services.
  • Vendors: we disclose information to vendors, service providers, contractors and consultants that need this information to provide services to us, such as companies that assist us with web hosting, fraud prevention, customer service, data enrichment, analytics, and marketing.
  • Professional Advisors: we disclose information to our lawyers and other professional advisors where necessary to obtain advice or otherwise protect and manage our business interests.
  • Legal Authorities and Others Involved in Legal Proceedings: we may disclose information to legal authorities and others for the Protection and Compliance purposes described above, including if we believe that disclosure is in accordance with, or required by, any applicable law or legal process, including lawful requests by public authorities to meet national security or law enforcement requirements and if we believe that your actions are inconsistent with our user agreements or policies, if we believe that you have violated the law, or if we believe it is necessary to protect the rights, property, and safety of Forerunner, our users, the public, or others.
  • Corporate Transactions: we reserve the right to disclose information in connection with, during negotiations of, or as an asset in certain corporate transactions, including the merger, sale of company assets, financing, or acquisition of all or a portion of our business by or to another company. Also, in the unlikely event of our bankruptcy, receivership, or insolvency, your information may be disclosed, transferred, or assigned to third parties in connection with the proceedings or disposition of our assets. 
  • Affiliates: we reserve the right to disclose information between and among Forerunner and any current or future parents, affiliates, subsidiaries, and other companies under common control and ownership.
  • Consent: we may disclose information when we have your consent or you direct us to do so.

Transfer of Information

Forerunner is headquartered in the United States and we have operations and vendors throughout the country. Therefore, we and our vendors may transfer your personal information to, or store or access it in, jurisdictions that may not provide equivalent levels of data protection to your home jurisdiction.

Applicant Information

When you apply for a position with Forerunner, we collect the information that you provide in connection with your application. This includes name, contact information, professional credentials and skills, educational and work history, and other information that may be included in a resume or provided during interviews (which may be recorded). This may also include demographic or diversity information that you voluntarily provide. We may also conduct background checks and receive related information. We may derive information or draw inferences about you based on the information we collect.

We use applicants’ information to facilitate our recruitment activities and process applications, including evaluating candidates and monitoring recruitment and hiring statistics. We use successful candidates’ information to administer the employment or independent contractor relationship. We may also use and disclose applicants’ information (a) to improve our Services and our recruiting and hiring practices, (b) as otherwise necessary to comply with relevant laws, (c) to respond to subpoenas or warrants served on Forerunner, (d) to protect and defend the rights or property of Forerunner or others, and (e) in connection with, during negotiations of, or as an asset in certain corporate transactions.

Children’s Personal Information

Our Services are not directed to, and we do not intend to, or knowingly, collect or solicit personal information from children under the age of 13. If an individual is under the age of 13, they should not use our Services or otherwise provide us with any personal information either directly or by other means. If a child under the age of 13 has provided personal information to us, we encourage the child’s parent or guardian to contact us to request that we remove that personal information from our systems. If we learn that any personal information we collect has been provided by a child under the age of 13, we will promptly delete that personal information.  

Third-Party Websites and Services

Our Services may include links to or redirect you to third-party websites, plug-ins, applications, or other services. Third-party websites and other services may also reference or link to our Services. This Privacy Policy does not apply to any information handling practices of these third-party websites, plug-ins, applications, or other services.
